GENERAL CONDITIONS OF CONTRACT FOR THE USE OF THE WEBSITE

Definitions.

Italesse means the company Italesse S.r.l. with a main office in 34015 Muggia (TS), via dei Templari no. 6, loc. Noghere VAT 009742280323

“Site” means the website www.italesse.com, managed by the company Italesse S.r.l., and registered in its name.
“User” or “You” means any visitor and/or user of the Site.
“Content” means the content offered to the User through the Site or specific sections of the Site.

This Agreement contains the terms and conditions relating to the use of the Site, and the services and products made available through the Site.

These terms and conditions govern the User’s responsibilities and, together with other aspects, the limits of Italesse’s liability. Before using the Site, please read this Agreement carefully and in its entirety.

By accessing any part or section of the site, you agree to be bound by these terms and conditions, and agree to abide by them.

If you do not agree to any of the conditions set forth in this Agreement, you should not use the Site.

Validity of the terms and conditions of use.

These terms and conditions represent the entire agreement between you and Italesse regarding your use of the Site, and replace any previous agreement or statement.

Italesse reserves the right, at its complete discretion, to modify all and/or part of these terms and conditions at any time, by making the new terms and conditions known through the Site. The new terms and conditions will be valid and effective from the moment they are published on the Site.

The use of the Site by the User will be subject to the terms and conditions published on the Site at the time of its use.

Site Contents and Products

Italesse takes every precaution to prevent the publication, on its Site, of content that represents or describes scenes or situations of physical and/or psychological violence or such that, according to the sensitivity of italesse.com Users, may be considered harmful to human rights and dignity of persons in all forms and/or expressions.

Users can access the Site from anywhere in the world, and the Site may contain references to products and services that are not available or are prohibited in the country where the User resides. The existence of such references does not imply that Italesse intends to make such products and services available in the User’s country or that such products and services may be legally used in the User’s country.

Any image, photograph and any representation and/or data on the Site must be considered purely indicative and/or illustrative. Italesse employs techniques aimed at ensuring that the photographs shown on the Sites are faithful reproductions of the original products, also using every possible technological solution to reduce inaccuracies to a minimum. In any case, there is always the possibility that there is a variation (also in relation to colour) in the display of the product image with respect to the product itself. Such variation may also derive from various causes relating to the technical and/or technological characteristics of the technological instrument used to navigate the Site. Consequently, Italesse cannot be held responsible for any inadequacy of the graphic representations of products shown on the Sites due to the aforementioned technical reasons.

Intellectual property rights.

The User acknowledges that any material on the Site (by way of example but not limited to: information, data, software, photographs, graphics, graphics, music, sounds, images, illustrations, drawings, icons, texts) is protected by copyright as well as intellectual property law and is the exclusive property of Italesse S.r.l. and/or third parties granted to Italesse S.r.l. for use.

Duplication, even partial reproduction, downloading, saving, publication or dissemination by any means and more generally any act of disposition and/or use of information or material from this Site, in all forms, through existing or future media and technologies, are prohibited, unless expressly indicated otherwise.

Brands.

“Italesse” is a figurative and denominative registered trademark owned by Italesse S.r.l., as well as all logos used within the Site and registered as trademarks by Italesse S.r.l. The trademarks and logos of third parties present on the Site are the exclusive property of their respective owners and are used within the Italesse.it Site for the sole purpose of identifying, describing, and advertising the products for sale on the Site. The use or reproduction in any form or manner of such trademarks and logos is prohibited.

Permitted use.

The User may only use the Site for legitimate activities and shall not use the Site for any speculative or fraudulent activity. It is expressly forbidden to use any part or section of the Site, information or material on the Site for commercial or advertising activities of any kind, except with the express written authorisation of Italesse S.r.l. The User who commits fraudulent and/or illegal and/or illegitimate acts will be prosecuted in accordance with the law.

Guarantees.

The User expressly declares that his/her use of the Site is solely at his/her own risk.

General limitation of liability.

Italesse cannot, in any case and in no way, be held responsible for any damage or injury, loss, or default caused by services or sections of the site which are not directly managed.

Under no circumstances shall Italesse and its collaborators be liable for any direct or indirect injury, loss, claim, or damage of any kind, even if arising from a contract or tort, or in any way connected with a use of the Site that does not comply with these terms and conditions, even if Italesse has been informed of the possibility of such damage.

If, despite the foregoing, Italesse is held liable for any damage or loss relating to the use of this Site, the User accepts and acknowledges that Italesse’s liability shall in no case exceed the cost (if any) incurred by the User in using the Site.

Each User who uses this Site for or on behalf of a Third Party agrees to indemnify and hold Italesse harmless from any liability for losses, damages, actions and claims (including defence costs), relating to the third party or to any breach of the User’s obligations as described above.

Applicable law and place of jurisdiction.

For any dispute arising from these terms and conditions or related to them, the Court of Trieste, Italy shall have exclusive jurisdiction.

For everything not expressly provided for herein, the provisions of the law in effect in Italy shall apply.
